BeSir Browser Terms of Service

Article 1 (Purpose)

These Terms and Conditions are intended to clearly define the rights, obligations, and responsibilities between the Company and Members regarding the use of BeSir Browser and related services (hereinafter "the Service") provided by Serverkit Inc. (hereinafter "the Company").


Article 2 (Definitions)

The definitions of terms used in these Terms and Conditions are as follows:

  1. "Service" means the BeSir Browser program and its associated AI agent execution and management functions, credit payment functions, APIs, and all ancillary services provided by the Company.
  2. "AI Agent" refers to artificial intelligence-based functions that perform automatic analysis, response, generation, and other tasks based on user commands or data.
  3. "Credits" are virtual usage units used for AI function execution, data processing, document analysis, API calls, etc., including credits included in subscription plans and credits purchased by Members.
  4. "Subscription Plan" refers to a paid service usage form billed on a subscription basis (monthly/yearly), with different credits, AI function scope, storage capacity, etc. provided for each plan.
  5. "AI Output" means outputs such as text, images, code, analysis reports, etc. generated by AI Agents from data input or requested by Members.
  6. "Member" refers to a person who agrees to these Terms and Conditions and enters into a service agreement with the Company to use the Service.

Article 3 (Effect and Amendment of Terms)

  1. These Terms and Conditions take effect when a Member agrees to them at the time of service registration.
  2. The Company may amend these Terms and Conditions to the extent that they do not violate relevant laws, and will notify Members at least 7 days in advance (30 days in advance if the amendment is disadvantageous to Members).
  3. If a Member continues to use the Service without explicitly expressing objection after the announcement of amended Terms, they are deemed to have agreed to the changes.

Article 4 (Membership Registration and Account Management)

  1. Members must accurately fill in their information according to the procedures established by the Company.
  2. Members may not use others' information or enter false information.
  3. Members are responsible for safely managing their accounts (ID, password) and may not transfer or lend them to third parties.
  4. The Company may immediately suspend or terminate accounts confirmed to be fraudulently used.

Article 5 (Use of Service)

  1. Members may install or access the BeSir Browser program provided by the Company and execute and utilize AI Agents within the scope determined by each subscription plan.
  2. For the purpose of improving the quality of AI functions, the Company may analyze and learn from data and AI Outputs entered by Members in de-identified form. However, information that can identify individuals is excluded.
  3. Members may freely use AI Outputs for commercial or non-commercial purposes, but must not infringe on relevant laws and third-party intellectual property rights.
  4. The Company does not guarantee the accuracy, completeness, or suitability of AI Outputs, and Members are responsible for interpreting and using such outputs.
  5. The Company may continuously update AI models or change functions to maintain service quality and enhance security.

Article 6 (Subscription Plans and Payment)

  1. The Service is provided on a monthly or yearly subscription basis, and the amount at the time of payment is charged.
  2. The functions, credits, storage capacity, support scope, etc. provided for each subscription plan are specified in detail according to the plan content within the Service, and the basic configuration table follows the table below.
  3. The Company will notify Members at least 30 days in advance when changing fees.
  4. Subscription payments are processed through automatic payment, and Members may cancel their subscription up to 1 day before the next scheduled payment date.
  5. Payment and billing conditions for corporate and enterprise Members are subject to separate contracts.

  • The detailed scope, payment amount, and function limits for each subscription plan are posted separately on the "Plan Information Page" within the Service.
  • The Company may adjust the subscription plan configuration and policies according to market conditions, technical circumstances, exchange rate fluctuations, etc., and will notify Members at least 30 days in advance of any changes.
  • This table and the subscription plan information posted within the Service are considered part of these Terms and Conditions, and the Company will provide advance notice in accordance with Article 16 when making changes.

Article 7 (Credit Usage Policy)

  1. Credits are virtual usage units within the Service used for AI function execution, data processing, document analysis, API calls, etc.
  2. Credits paid by Members are reflected in the account immediately upon payment, and usage history and balance can be checked on the account information page within the Service.
  3. Credits include the basic allocation provided per subscription plan and paid credits purchased separately by Members.
  4. Credits charged through subscription are valid only within the billing cycle (monthly or yearly), and unused portions do not carry over to the next billing cycle.
    • However, for yearly subscriptions, credits are distributed monthly, and each monthly distribution is also valid only within that month.
  5. Refunds are available only for paid credits purchased separately by Members, and the refund amount is calculated based on the unused balance ratio.
    • Basic credits provided through subscription are considered as amounts already included in the usage fee, and basic credits are not eligible for refund.
  6. Credits can only be used within the validity period, and expire and are not recoverable when the period expires or the service agreement is terminated.
  7. Credits cannot be transferred or assigned to other accounts.
  8. Credits provided through promotions, events, or bonuses cannot be refunded in cash or transferred.
  9. The Company may change the scope of use, unit price, minimum payment unit, validity period, etc. of credits, and will notify Members at least 30 days in advance of any changes.
  10. The usage period and refundable period for credits are limited to within 1 year from the date of payment.

Article 8 (AI Data Utilization and Quality Improvement)

  1. The Company may de-identify and use data and outputs generated by Members during service use for learning and analysis to improve AI function performance and service quality.
  2. De-identified data is processed in a form that cannot identify individuals and is managed with protective measures in accordance with applicable laws.
  3. The Company does not leak AI Outputs externally or use them for commercial sale purposes without the explicit consent of users.
  4. The Company separately notifies data processing, retention, and destruction procedures through the Privacy Policy.

Article 9 (Rights and Responsibilities for AI Outputs)

  1. Members may freely use AI Outputs for commercial and non-commercial purposes. However, they must not infringe on relevant laws and the rights of third parties.
  2. However, the Company may use such outputs in de-identified form for internal analysis and learning to improve service quality and model enhancement. Personal information is not included in de-identified data.
  3. Members must not infringe on third-party intellectual property rights such as copyrights, trademarks, and trade secrets when using AI Outputs.
  4. The Company is not liable for errors, inaccuracies, bias, etc. in AI Outputs unless there is willful misconduct or gross negligence.

Article 10 (Refunds and Subscription Cancellation)

  1. Monthly subscription plans are fully refunded if cancellation is requested within 7 days from the payment date, and yearly subscription plans are fully refunded if cancellation is requested within 14 days from the payment date.
  2. The amount corresponding to the period already used or credits used from the subscription renewal period is deducted from the refund amount.
  3. If recurring payment is cancelled, no fees will be charged from the next billing cycle after the cancellation date.
  4. Refunds are processed through the original payment method and currency used at the time of payment (e.g., KRW, USD, etc.), and if not possible, may be processed through a reasonable alternative method designated by the Company.
  5. Refund requests can be made directly through the My Page within the Service or by contacting customer support email (support@server-kit.com).
  6. Promotional credits, free credits, or credits whose validity period has expired are excluded from refunds.

Article 11 (Member Obligations)

  1. Members must comply with relevant laws, Terms and Conditions, and notices when using the Service.
  2. Members may not transfer, lend, or resell the Service to third parties without prior approval from the Company.
  3. Members must not engage in the following activities:
    • Stealing others' accounts, entering false information, or unauthorized access
    • System modification, reverse engineering, or attempting to copy AI models
    • Uploading illegal content, infringing on third-party rights, spam-like requests
    • Activities that interfere with the stable operation of the Service

Article 12 (Company Obligations)

  1. The Company will do its best to provide stable service.
  2. The Company protects Members' personal information in accordance with relevant laws such as the Personal Information Protection Act.
  3. The Company maintains service stability and reliability through regular security checks.

Article 13 (Service Changes and Suspension)

  1. The Company may change or suspend all or part of the Service for technical, operational, or policy reasons.
  2. When making changes or suspensions, the reason, date, and scope will be announced in advance, and post-notification may be provided in urgent cases.
  3. The Company is not liable for damages caused by service changes or suspensions unless there is willful misconduct or gross negligence.

Article 14 (Usage Restrictions)

  1. The Company may restrict a Member's use of the Service if any of the following reasons exist:
    • Payment refusal, refund abuse, providing false information
    • Identity theft, account sharing, use for illegal purposes
    • Abnormal AI system calls, unauthorized data extraction, etc.
  2. The Company will notify the reason and period of usage restriction via email or in-service notification.
  3. Members may file an objection, and usage will be resumed if deemed legitimate.

Article 15 (Damages and Disclaimers)

  1. If damage is caused to a Member due to the Company's willful misconduct or gross negligence, the Company will compensate within the scope prescribed by law.
  2. The Company is not liable in the following cases:
    • Damages caused by Member negligence or illegal acts of third parties
    • Damages caused by errors, inaccuracies, or prediction failures in AI Outputs
    • Damages caused by force majeure (natural disasters, war, system failures, etc.)
    • AI Agents operate based on automated algorithms, so the Company does not guarantee that the generation process or output content of AI Outputs is always accurate or complete.
  3. If a Member causes damage to the Company by violating these Terms and Conditions or applicable laws, the Member must compensate for such damage.

Article 16 (Notifications and Announcements)

  1. The Company may notify Members of necessary matters via email, text message, in-service notifications, or posting on the notice board.
  2. For announcements to all users, the Company may substitute this with posting on the in-service notice board, pop-ups, or banners. However, matters that significantly affect users' rights and obligations will be separately communicated via email or pop-up.
  3. The Company is not responsible for any disadvantage arising from a Member's failure to notify the Company of changes such as contact information.
  4. The Company will notify important matters such as Terms and Conditions changes and service policy changes at least 7 days in advance, or 30 days in advance for disadvantageous changes.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms and Conditions are governed by the laws of the Republic of Korea.
  2. Disputes arising in connection with the use of the Service shall be subject to the jurisdiction of the Seoul Central District Court.
  3. For overseas users, relevant local laws such as GDPR will be complied with, and mutual consultation is the principle in case of disputes.
  4. In case of disputes between Members and the Company, the "Consumer Dispute Resolution Standards" shall apply.

Supplementary Provisions

  • These Terms and Conditions are effective from November 1, 2025.
  • Previous Terms and Conditions are replaced by these Terms and Conditions.
